1. Parties

1.1 The website operating under the name www.ecift.com is managed by Elit Teknoloji Hizmetleri İnternet Anonim Şirketi (“eÇift”), located at Yeşilce Mah. Dalgıç Sok. No:3/5 Kat:1, 34418 Kağıthane, Istanbul, Turkey.

1.2 Members acknowledge that these Terms of Use (“Terms”) enter into force upon their registration on the Site and that they are obliged to comply with these Terms.

1.3 eÇift and the Members shall individually be referred to as a “Party” and collectively as the “Parties.”

2. Definitions

2.1 Site: The website accessible at www.ecift.com.

2.2 Standard Member: A person who has completed the registration form, accepted the Terms of Use and Privacy Policy, and completed the registration process.

2.3 Premium Member: A member who has upgraded their Standard Membership to Premium Membership by paying the applicable fee and thereby gaining Premium Member rights.

2.4 Member: Refers collectively to both Standard Members and Premium Members.

2.5 Personal Data: Any information relating to an identified or identifiable natural person as defined under the Turkish Personal Data Protection Law No. 6698.

3. Subject Matter of the Terms

These Terms govern the conditions for using the services provided on the Site and define the rights and obligations of the Parties. All announcements, disclosures, and policies published on the Site form an integral part of these Terms upon publication.

4. Rights and Obligations Regarding Membership

4.1 eÇift may accept or reject membership applications at its sole discretion without providing justification. Creating multiple accounts may result in immediate cancellation without refund.

4.2 To become a Member, the individual must be at least 18 years old and must not have previously violated these Terms. Individuals who do not meet these requirements shall not acquire membership rights.

4.3 Upon acceptance, Members are granted access to their personal account and the Site database. Members logging in via social media grant the necessary permissions for such access.

4.4 Members complete a personality analysis test based on scientific criteria. The resulting profile is used for compatibility analysis and service optimization. eÇift does not guarantee the accuracy or outcomes of such analyses.

4.5 Approval of a member profile does not constitute a guarantee regarding the accuracy or legality of its content.

4.6 Personal contact information may not be included in profiles. Profiles are visible to other Members until membership termination.

5. Premium Membership

5.1 Premium Membership is a paid service offering enhanced features. Membership becomes effective upon full payment and acceptance of the Distance Sales Agreement.

5.2 Premium Membership periods may be 3, 6, or 12 months, subject to modification by eÇift.

5.3 Premium Members may send messages, view restricted photos, and access additional Premium services.

6. Data Protection and Privacy

By using the Site, Members consent to the collection, processing, storage, and transfer of Personal Data, including sensitive data, in accordance with applicable law and the Privacy Policy.

7. Limitation of Liability

eÇift shall not be liable for any direct or indirect damages arising from the use of the Site, except in cases of gross negligence.

8. Force Majeure

Neither Party shall be held liable for failure or delay caused by events beyond reasonable control, including natural disasters, strikes, or infrastructure failures.

9. Entry into Force

These Terms enter into force upon acceptance by the Member.

10. Suspension and Termination

eÇift may suspend or terminate memberships in case of violation of these Terms. No refunds shall be issued upon termination.

11. Waiver

Any waiver must be made in writing and shall apply only to the specific instance.

12. Governing Law and Jurisdiction

Turkish law shall apply. Istanbul Central Courts and Enforcement Offices shall have jurisdiction.

13. Notices

Notices may be sent via the Site, email, fax, or postal mail.
